De rode draad in Recht voor natuur is het contrapunt van recht en beleid in de groene ruimte tegen de achtergrond van het verval van de rechtsstaat naar beleidsstaat. In zijn teksten laat Fred Kistenkas zien dat omgevingsrecht en omgevingsbeleid soms samenwerken, maar vaker botsen tot een lelijke dissonant.
Zijn mantra: stop de verbestuurskundiging van het recht, want rechtsregels zijn belangrijker dan beleidsprogramma’s, uiteindelijk is alleen het recht afdwingbaar bij de rechter.
Zijn wens: laat recht en beleid elkaar versterken ten behoeve van een mooiere, groenere wereld.
Mr. Dr. F.H. (Fred) Kistenkas (1959) is rechtswetenschapper. Hij was van 1983- 2003 wetenschappelijk medewerker staatsrecht aan de Universiteit van Amsterdam (UvA) en van 2003-2023 associate professor en senior onderzoeker omgevingsrecht aan Wageningen University & Research (WUR).
